Senator Leila De Lima Was Issued Another Arrest Warrant For Drug Trafficking

June 25, 2017 0

Manila City - De Lima’s legal counsel is pushing for the arrest warrant to be dropped, seeing it as the weakest among the 3 drug cases that De Lima currently faces from the Department of Justice (DOJ).

Senator De Lima is still currently under the custody of the Philippine National Police (PNP) in their custodial center located within Camp Crame. She was arrested and detained on February 23, 2017, also for drug charges. Judge Juanita Guerrero ordered her arrest

The DOJ accused De Lima and Dera of conspiring to extort money from Peter Co, an inmate in Bilibid. Co claims in an affidavit that Dera blackmailed him by detaining and threatening his niece, Sally. Co claims Dera received 2 out of the 5 million pesos that he extorted from the inmate. Dera also allegedly took 4 of Co’s vehicles and used them during Sen. De Lima’s 2016 campaign. Co adds that Dera received 3 million pesos from Co’s niece, which he used to finance Sen. De Lima’s campaign.

In an interview with GMA, Padilla said:

“Dera denied knowing Senator Leila and there’s clearly no trail of the supposed vehicles and the alleged campaign donation that would have any link to Senator Leila. It’s the weakest case for the prosecution.”

Dionisia Pacquiao knocks out BIR in P1.4-M tax case

June 25, 2017 0

MANILA — The Court of Tax Appeals has cancelled the P1.4-million tax dues of Dionisia Pacquiao, the celebrity mother of boxing champion Manny Pacquiao, because the Bureau of Internal Revenue violated her right to due process.

In a 26-page decision, the CTA Second Division granted Pacquiao’s petition for review against the January 2015 final decision on disputed assessment (FDDA) issued by then-Revenue Region No. 18 Director Thelma Milabao.

The 2015 FDDA junked Pacquiao’s protest against the income tax and value-added tax assessments imposed on her for the year 2010, prompting her to go to court.

he CTA invalidated the tax bill because Pacquiao was not properly served the preliminary assessment notice (PAN), which would inform her of the assessment as required by Section 3 of Revenue Regulation No. 12-99.

Pacquiao had insisted that she did not receive the PAN dated Sept. 16, 2013. A certain Analyn Abrera received the notice on Oct. 18 but the BIR failed to establish how she was related to the General Santos City resident.

“To consider the receipt of the PAN by another person as deemed receipt [sic] by the taxpayer itself, despite the lack of prior verification of the former’s authority of agency, will put taxpayers in a disadvantageous position and at the mercy of revenue officers,” read the decision.

Even if the PAN was properly served, the court also faulted the BIR for not giving Pacquiao the chance to answer the notice.

The BIR issued both the final assessment notices (FAN) and the final notice of demand on Oct. 16, two days before Pacquiao supposedly received the preliminary assessment notice.

Although taxpayers are given 15 days to respond to the preliminary assessment notice before the final assessment notice is issued, revenue officer Leilah Jane Dohinog testified that the BIR counted this period from the issuance of the notice and not Pacquiao’s receipt.
“It can be inferred that respondent [Milabao] had no intention of giving petitioner [Pacquiao] the opportunity to be heard on her arguments against the PAN (preliminary assessment notice), if any,” the decision read. “Clearly, respondent failed to observe due process when she issued the FLD even before petitioner supposedly received the PAN.”

“The assessment issued by respondent is void and a void assessment bears no valid fruit,” concluded the unanimous ruling penned by Justice Caesar A. Casanova with the concurrence of Justices Juanito C. Castañeda Jr. and Catherine T. Manahan.

Dionisia Pacquiao’s case arose from an investigation in 2013 on her possible tax liabilities, during the height of the BIR’s P3.299-billion tax case against her son Manny and his wife Jinkee.

The BIR, at the time, issued a freeze order on the boxer’s Philippine bank accounts and properties, due to his alleged failure to pay income and value-added taxes for earnings from his boxing fights in the United States from 2008 to 2009.

The CTA en banc on April 2014 issued an order stopping the BIR from garnishing the Pacquiaos’ assets to foot the bill. The Pacquiao matriarch’s tax case is not connected to the pending petition by her son and daughter-in-law.

This Netizen Got His Driver’s License Cut in Half by a Bogus MMDA Traffic Enforcer!

June 25, 2017 0

traffic enforcer is supposed to guide motorists on the road for their safety and for them to adhere to traffic rules and regulations. In Metro Manila, they work under the MMDA (Metro Manila Development Authority), who oversees the traffic on the road.
However, not all traffic enforcers are to be trusted. Facebook user Ronan Pastrana posted a video on his account wherein he detailed his encounter with what he alleges is a bogus MMDA traffic enforcer. His video has already garnered 302 thousand views as of this writing.
The screen capture above is of the bogus traffic enforcer who Pastrana encountered. According to his video description, he encountered the man as he was driving along Commonwealth Avenue in Quezon City bound towards Tandang Sora at around 3:00 in the afternoon of June 23.
Pastrana got hailed by the man for “overspeeding,” or going beyond the required speed limit. According to Philippine Star, Commonwealth Avenue has a speed limit of 60 kilometers-per-hour. The netizen admitted to this certain violation and narrated that he pulled his car over.
When he approached the traffic enforcer, Pastrana was shocked beyond words when the enforcer asked for his driver’s license and then cut it in half. Pastrana mentioned that he had a temporary driver’s license with him at the time, which has a five-year validity period. Both his license card and temporary license were placed in the same case and the traffic enforcer took them both.
Pastrano narrated that he also had a hard time obtaining his ticket for the violation since the enforcer made it difficult. But what he couldn’t comprehend was why his license was cut in half by the traffic enforcer. He also asked netizens if what the enforcer did was legal.
According to MMDA’s website, a traffic enforcer can only confiscate a driver’s license but legally they are not allowed to vandalize the license, this includes cutting it in half. They are also not allowed to confiscate a driver’s license if the violator has only committed his offense for the first time.

Drivers, beware! If you regularly ply Commonwealth Avenue, please be wary of this allegedly bogus traffic enforcer and report him to the proper authorities! Let us know your thoughts about this in the comments section below!

Marcos urged to pay P2.08-B Comelec expenses due to his protest

June 24, 2017 0

The P2.08 billion is the cost of the non-return of 97,365 vote-counting machines to technology provider Smartmatic

MANILA, Philippines – Lawyers of Vice President Leni Robredo insist former senator Ferdinand Marcos Jr must shoulder the expenses that the Commission on Elections (Comelec) has incurred because of his election protest.
Robredo's lawyers Romulo Macalintal and Maria Bernadette Sardillo said they reiterated this in a motion filed before the Supreme Court (SC), sitting as the Presidential Electoral Tribunal (PET), on Tuesday, June 20.
In their motion, Robredo's lawyers also asked the PET to direct the Comelec to clarify who should pay for the expenses the poll body mentioned in an earlier manifestation.
Following an order from the PET, the Comelec earlier provided an itemized list of expenses it may be required to pay under its contracts concerning the May 2016 automated elections.
The Comelec then said it is expecting to pay up to P2.08 billion due to the failure to return the 97,365 vote-counting machines (VCMs) to technology provider Smartmatic on or before December 1 last year.
Aside from this, the poll body also informed the PET that it is incurring a monthly fee of P5.62 million for the rental and operational expenses of its warehouse in Sta Rosa, Laguna.
Over P2.3 million of this is for the lease of the warehouse, P2.1 million for the equipment rental, P461,164 for salaries of personnel there, and around P261,280 for electricity and water costs.
Macalintal reiterated that these costs came in because of Marcos' protest against Robredo, which was filed June 29 last year.
"Noong naghain ng election protest si Marcos noong June 2016, isa sa mga hiniling niya ay ang pagsasagawa ng technical examination at forensic investigation ng mga VCMs. At ang mga VCMs na iyan ay iyong ginamit sa lahat ng 92,508 clustered precincts," Macalintal said.
(When Marcos filed his election protest in June 2016, one of his requests was to conduct a technical examination and forensic investigation of the VCMs. And these VCMs are those used in all 92,508 clustered precincts.)
He reiterated that Marcos blocked the Comelec's closure and stripping activities for the VCMs. (READ:TIMELINE: Marcos-Robredo election case)
The manifestation of the Vice President's camp came as they are about to face another financial burden – settling the P7.7-million balance for the protest fee required by the PET on or before July 14.
Robredo was required to pay a total of P15.7 million for the service fee of the 31,278 established precincts she is contesting. She paid the first installment of P8 million on May 2.
Meanwhile, the PET required Marcos to pay P66 million for the 132,446 established precincts he is questioning. He paid the first half of P36 million on April 17, saying 40 donors helped him raise the money. The second installment of P30 million should be paid on or before July 14 as well.
Marcos' spokesperson Vic Rodriguez called the latest motion a "brazen attempt" that "insults to the highest order the intelligence and sentiment of the Filipino people."
"She is obviously in panic now that the case is moving. Instead of her usual thoughtless buck passing, why won't she make her beloved Liberal Party (LP), Comelec, and partner Smartmatic accountable for the mess they did to our system?" he said.
Marcos accused Robredo and the LP of orchestrating massive electoral fraud – the basis of his election protest against her.

Koko Pimentel waives assistance cap for senators helping Marawi victims

June 23, 2017 0
Aquilino Pimentel III

Senate President Aquilino “Koko” Pimentel III has issued a “special” order allowing senators to give assistance to displaced Marawi residents more than the 5-percent limit set by the Senate rules.
Pimentel pointed out that under Section III, Item 17.1 of Memorandum Circular 2016-002, the Senate President “may grant exemption to the limitation of 5% for Welfare Assistance expenses from the budget of each senator’s office.”
“The war against terrorism is not just won with bullets and bombs. It is won by the unity of the people, and through this measure, I hope to show our displaced brothers and sisters that they are not forgotten,” Pimentel said in a statement on Saturday.

Thousands of Marawi residents had been displaced since the fighting between government forces and the Maute terrorist group erupted last May 23. President Rodrigo Duterte has already placed the entire region of Mindanao under martial law.
And as Ramadan about to end, Pimentel urged the government to provide three-meals a day for Marawi residents, saying the need for food might increase in evacuation centers.

Eid al-Fitr, which falls on Monday, June 26, marks the end of the fasting month of Ramadan and is welcomed with great joy throughout the Muslim world.
“Let’s join our Muslim brethren in celebrating Eid al-Fitr with prayers for peace and giving them help in their hour of need,” the Senate leader added.

MILF asks Maute gunmen to free hostages

June 05, 2017 0

ILIGAN CITY – A top official of the Moro Islamic Liberation Front (MILF) has asked for the release from captivity of a Catholic priest and more than 200 other civilians held by Islamic State-inspired militants in Marawi City.
“We appeal to those who are still holding captive Fr. Chito (Teresito Suganob) to release him in the name of peace,” said MILF vice chair for political affairs Ghadzali Jaafar.
Suganob, vicar-general of the prelature of St. Mary in Marawi and chaplain of the Mindanao State University (MSU), was snatched by militants in the early hours of the siege on the city last May 23, along with two lady church workers.

In a proof of life video released by the militants last week, Suganob said he was part of a throng of some 240 individuals being held captive by the militants in an undisclosed location.
Speaking amid ruined buildings, he specified that he was with a female professor of the MSU; two lady church workers, who presumably were the ones taken with him at the prelature; two male and five female teachers of the Dansalan College Foundation; and some 200 carpenters, househelps, children, youth, Christians and Subanen people.
“He (Suganob) is a priest, a religious leader, in the time of prophet Muhammad, He respected so much religious leaders and non-combatnats, like children, women, the elderly,” said Jaafar, also chair of the Bangsamoro Transition Commission (BTC).
By releasing Suganob “the soonest possible time, we are sure that such deed will be rewarded by Allah,” Jaafar added.
Suganob has worked for over 20 years in various capacities in the prelature which was established by the Vatican in the mid-1970s “to provide a reconciling presence” among the Muslims.
Apart from interfaith dialogues, Suganob has been active in helping Maranao activists advance the cause of clean elections in the province.
The MILF has been helping the Philippine government set up a peace or humanitarian corridor in a bid to rescue civilians still holed up in homes and buildings for some two weeks now, unable to flee to safety for fear of being hit in the crossfire.
Maranao women leader Samira Gutoc-Tomawis called on “everyone who are in the position to influence the Maute group on humanitarian grounds” to help in securing the freedom of Suganob and the other hostages.

“We appeal to government to carefully consider its military options, giving greater weight to the safety of hostages and trapped civilians,” she said.
The peace corridor initiative has brought a four-hour respite from fighting since Sunday, although it is very specific only to a three-kilometer stretch of space that runs across Marawi’s business district.  SFM/rga

Ilocos Norte Governor Imee Marcos on Monday said she supports President Rodrigo Duterte’s declaration of a 60-day martial law in Mindanao.
In a chance interview at the Court of Appeals, Marcos said we should trust Duterte in making decisions in solving matters of national security.
“Tulad ng nakararami, nananalig tayo sa ating Presidente ‘pag matters of national security at sa nakikita natin sa mga video footage at kwento ng mga kapatid nating Muslim, talagang nanganganib ang kanilang buhay,” Marcos told reporters.

(Like most people, we trust the President when it comes to national security, and according to the video footage and the stories of our Muslim brothers, their lives are really in danger.)
“We need to help the President and the military in solving this threat,” she added as she asked for the public’s support for the government.

Maute Group denies alliance with ISIS

May 25, 2017 0
Marawi checkpoint

DAVAO CITY – Maute Rebel Leader Abdul Jah Khoul SallSallani denies alliance with the foreign terrorist ISIS.

Fighting between armed men and government forces resumed on Thursday morning in Marawi City.
Maki Panandigan, a resident of Marawi City, called the Philippine Daily Inquirer at 9:45 a.m. Thursday to say that fighting has resumed in the city.
“It has started,” Panandigan said.

“I can see smoke,” he added, apparently referring to a fire in the area.
The fighting resumed a day after the mass evacuation of residents to nearby Lanao del Sur towns and Iligan City, following a spate of clashes when groups linked to the Abu Sayyaf and the Maute Group attacked Marawi City starting Tuesday afternoon.
This prompted President Duterte to declare martial law in all of Mindanao two nights ago.  SFM

PNP denies gov’t orchestrated Marawi terror attack

May 25, 2017 0
Resulta ng larawan para sa PNp denies orchestrated marawi

The Philippine National Police (PNP) on Thursday quelled speculation that the terror attack in Marawi City was orchestrated by the government to justify President Rodrigo Duterte’s declaration of martial rule in Mindanao.
“What would we get from (doing that)?” Chief Supt. Dionardo Carlos, PNP spokesperson, said in a news conference at Camp Crame.
He said those accusing the Duterte administration of plotting the attack should back their claim with evidence.

“Huwag tayo mag-isip ng masama,” he said. “Mag-isip tayo kung paano maayos ‘yung bansa.“
(“Let’s not be negative in our thinking. Let’s think kof how we can put the country in order.”)
“If we keep on dividing the people by speculation, they should come out and show proof,” he added.
Carlos also stressed that PNP and military personnel on the ground had been doing their best to protect the people of the terror-stricken Marawi and restore normalcy in the city.
“Mas mapapabilis kapag tayo ay nagtulong-tulong na alisin ang Maute at Abu Sayyaf groups,” he said.
(“Things will work out faster if we can help each other eject the Maute and Abu Sayyaf groups.”)
Since being elected president in July, Duterte has mentioned several times in his public speeches about the possibility of his declaring martial law in the country.
On May 23, he placed all of Mindanao’s 27 provinces and 33 cities under martial law following the armed clashes between government forces and Maute bandits, who had pledged allegiance to the international terrorist group Islamic State.

Under the Constitution, martial law would only be in effect for 60 days. But Duterte said he might consider extending it for a year and expanding its coverage to the Visayas, and even Luzon, if the terrorists should reach those areas. /atm

Martial law Duterte’s initiative ‘since many months ago’ – Aguirre

May 25, 2017 0
President Rodrigo Duterte and Justice Secretary Vitaliano Aguirre II (INQUIRER FILE PHOTOS)

MANILA — President Duterte opted to put the whole of Mindanao under martial law to prevent the country from disintegrating in the wake of the violent attacks mounted by the Maute group in Marawi City, Justice Secretary Vitaliano Aguirre II said on Thursday.

He also played down rumors that he was the “architect” of Mr. Duterte’s decision to impose martial rule in southern Philippines, which many feared might lead to human rights violations.
“It’s the President’s own initiative since many months ago,” Aguirre said in a text message to reporters.

The justice secretary rejected criticisms that the Chief Executive might have overreacted in declaring martial law, noting that the 1987 Constitution has authorized the President to employ such measure.
“The (martial law) proclamation is in accordance with the Constitution and necessary to avoid the dismemberment of our nation,” he argued.
He said groups which raised objections to Mr. Duterte’s action saw it as an “obstacle to their own agenda.”
Meanwhile, Aguirre said he met with some officials of the Department of Justice (DOJ) in Mindanao who raised security concern in prosecuting possible cases to be filed against arrested Moro
extremists.

He said the DOJ might ask the Supreme Court for the creation of special courts which would handle the cases of Maute members to ensure the safety of judges and government prosecutors.
According to Aguirre, the regional and city prosecutors may also move the trial of cases outside of Mindanao. SFM

A copy of her Statement of Assets Liabilities and Net worth (SALN) released on Tuesday shows Robredo's net worth decreased from P11,053,138 in June 2016 to P8,878,111.43 in December 2016, down by about P2.1 million.

The SALN also shows that Robredo's total assets decreased from P17,953,138 to P15,778,111.43 during the same period. Her liabilities, meanwhile, remain at 6.9 million.

Last week, President Rodrigo Duterte reported a net worth of P27,428,862.44 in December 2016, an increase of over P3.3 million (14 percent) from the P24,080,094.04 he declared in June 2016.
Duterte's total assets totaled P28,428,862.44 million as of the end of 2016. However, he also declared total liabilities of P1 million due to a personal loan from Samuel Uy.
The increase in the President's net worth is also partly due to the decrease in his liabilities. His personal loan from Uy decreased by P100,000 making his liabilities down to P1 million from P1.1 million.

'Na-ano lang': Sotto twits Taguiwalo for having children out of wedlock

May 03, 2017 0

Taguiwalo daughter: 'No woman deserves that kind of treatment.'

MANILA - (UPDATED) Senator Vicente "Tito" Sotto III on Wednesday needled Social Welfare Secretary Judy Taguiwalo for having two daughters outside marriage. Sotto brought up Taguiwalo's status as a solo parent during her confirmation hearing before the Commission on Appointments (CA), where the bicameral body assessed whether or not her cabinet posting should be affirmed. "On the lighter side, Sen. Drilon and I were looking at the personal information about you and you have 2 children, daughters ba or sons? Two daughters. But you're single," Sotto told Taguiwalo. Taguiwalo answered in the affirmative, saying: ""My life has never been a normal one. I never had a whole mother-father-children kind of thing, except when I was growing up in Bacolod." She explained that she was a student activist in the University of the Philippines during the Martial Law years. Taguiwalo, a human rights victim during the Marcos regime, then said she spent her life in the underground and in prison from 1972 to 1986. "My story will be different from the stories of those who have gone through UP, corporation, et cetera," she said. Sotto's response was reminiscent of his noontime show jokes: "In the street language, when you have children and you are single, ang tawag doon ay 'na-ano lang.'" Several people in the room laughed at Sotto's remarks while Taguiwalo merely pursed her lips. Taguiwalo, a former UP professor, then told the senator, "Mr. Sotto, I teach Women's Studies so we respect all kinds of families, and that includes solo parents." Despite the joke, Sotto said he backed Taguiwalo. "You have my 100 percent support," Sotto said as the titters subsided. A daughter of Taguiwalo, who requested not to be named, took offense over Sotto's remarks and demanded a public apology for her mother. "I think my mom deserves a public apology from Tito Sotto... No woman deserves that kind of treatment," she said. Sotto's comments also drew comments online, with several scoring him for sexism and misogyny.

@DiNaProfMSSyj Tito Sotto's demeanor against Taguiwalo was intended to gain media coverage. Nothing more. It depicted though his indecency as a senator.
Yung tanungan ni tito sotto kay Judy Taguiwalo, eat bulaga lang?
Sobrang low!!! Eh ano kung solo parent sya with 2 daughters?
